Obtain and Record

The Client Identification Rules require you to obtain and record specified information about clients.

The Personal Information Protection Act (PIPA) requires that organizations (including law firms) do not collect, use and disclose personal information that they do not require. If you photocopy an individual client’s driver’s license for identification purposes without authorization from the client, you are collecting personal information that exceeds your purpose of obtaining their name and address for identification purposes. It is also not authorized by the Rules of the Law Society of Alberta. To fulfil the requirements of the Rules, only record the potential client’s information by making written notes of the client’s name, address (work and home), phone number (work and home) and occupation.
