Paying Your Fees, Disbursements or Expenses from a Trust Account

Trust money may be withdrawn or transferred to pay fees, disbursements or expenses under the Rules of the Law Society of Alberta, Rule 119.28(3) provided that:

    • the billing relates to services actually provided, expenses actually incurred or to reimburse the law firm for a disbursement; and
    • the law firm either delivers the billing to the client before the withdrawal or transfer, or forwards the billing concurrently with the withdrawal or transfer.

When trust money becomes payable to a law firm, it must be withdrawn as soon as practicable or no later than one month after the law firm becomes entitled to the trust money.
