7.8 Obtain and Record

The Client Identification Rules require that you obtain and record specified information about clients (as set out in Chapter 7).

PIPA requires that organizations (which includes law firms) do not collect, use and disclose personal information that they do not require. If you photocopy an individual client’s driver’s license, you are collecting personal information that exceeds your purpose of obtaining their name and address for identification purposes. It is also not authorized by the Rules of the Law Society.

To fulfil the requirements of the Rules, you need only record the potential client’s information by making written notes of the client’s name, address (work and home), phone number (work and home) and occupation.
