There is no ethical obligation for an SRP to accept or fulfill a trust condition. You will need to consider how documents and funds can be managed without the imposition of trust conditions on the SRP, to ensure the matter proceeds as intended and that your client’s interests are protected. You may, for example, insert specific paragraphs into a settlement agreement about what the SRP is expected to do before they may receive settlement proceeds.
